According to documents obtained by
RadarOnline, Teresa's former employee is also seeking a payday for the star's creditors! “My function is to be a representative of all the unsecured creditors of the estate,” he explained. “As far as I know, none of them have been paid. That’s my understanding.”

Given that they are “general creditors” without collateral, John claims "this action would benefit the unsecured creditors,” but also assured that if there are any leftover funds, they would be for Teresa to keep.

As for the malpractice case — James is accused of making “material errors” that ultimately landed her in prison — the 43-year-old star’s current attorney Carlos Cuevas says they are prepping papers so reopen the case.

“Mrs. Giudice suffered a unique injury,” he said. “She was incarcerated, and the fact that she had to be separated from her children for a year, it’s difficult to quantify.”

Both sided are scheduled to battle things out on May 24. “This is something that is very important to her because if she is successful proving that her attorney committed malpractice,” a legal source explained.
