As mandated by the court on July 3, Kelly Rutherford was finally reunited with her son, Hermes, 9 and daughter, Helena, 6. She was separated from her children due to her three-year-long custody battle with her ex-husband, Daniel Giersch. “I am over the moon that my children are back in the United States. I haven’t stopped hugging and kissing them,” Kelly Rutherford exclusively tells Star.

In 2012, the judge ruled that her two children would temporarily visit France and Monaco with their German father. The kids had to remain there while he figured out his immigration issues so he could be granted re-entry into the U.S.

Rutherford, best known for her role on the hit TV show Gossip Girl, explains, “Obviously, three years is not a visit — especially in a young child’s life when, as every parent knows, each moment is priceless because children grow and change so quickly.”

Although she has missed a chunk of time with her kids already, she is optimistic that they will be able to stay in the U.S. for good. “Now that Congress is involved and people in Washington are talking about how this case is an example of a much bigger problem, I’m hopeful my children will be able to stay here, and go to school here and live here just like other American children.”

Adds Rutherford, “I am looking forward to watching them grow and thrive here in the United States — with family and friends who love them very much, and have missed them terrible over these past few years.”
